Since the country code is set at the VC, that would be no.

I two US APs in my Home lab and one Worldwide. The US versions is of cause
fixed and one of those is the one I prefer to be VC.
At what level does the discovery protocol for Joining run? I suspect L2. Is
    that correct.

If I can not use all my APs in the samr VC I will end up with 2 VCs
    (correct ?)

Even by using two different IP subnets will this will still cause problems
if the are on the same VLAN? Actually default VLAN.

I f was to simulate solution with 2 APs in the US and one in a remote
network in EU linked to the same network, what do I need to do?

It will not join the cluster of the existing VC nor it'll become a separate VC. You need to convert it to standalone mode and use it with a different country code on the same VLAN.
